1. About us
This website is operated by Fakhari Corp Limited, a company registered in the United Kingdom, trading as Jaffary and Jaffary Studios ("we", "us", "our"). Throughout the site, the terms "we", "us" and "our" refer to Fakhari Corp Limited.

2. Agreement to these terms
These Terms of Service ("Terms") govern your access to and use of jaffary.com (the "Site") and any purchase you make through it. By visiting the Site or placing an order, you agree to be bound by these Terms.
Please read them carefully. If you do not agree with any part of these Terms, you should not use the Site or place an order.
Our Privacy Policy, Refund Policy and Shipping Policy form part of these Terms and are incorporated by reference.
3. Eligibility
You must be at least 18 years old, or the age of legal majority in your country of residence, to place an order. By placing an order you confirm that you meet this requirement and that the information you provide is accurate and complete.
We may refuse service, cancel orders or close accounts at our discretion, including where we reasonably suspect fraud, abuse, or a breach of these Terms.
4. Products
Our products are made in limited runs. Colours, fabrics and finishes are shown as accurately as possible, but we cannot guarantee that the colours displayed on your screen are an exact reproduction of the physical item.
Garments described as washed, faded, hand-finished or embroidered will vary slightly between individual pieces. This variation is a characteristic of the product, not a defect.
Availability is not guaranteed. Once a colourway sells through, we are under no obligation to reproduce it.
5. Prices and currency
Prices are shown in the currency selected on the Site and are determined by the market associated with your shipping country. Prices may change at any time before you place an order.
Whether tax is included in the displayed price depends on your delivery destination. Any applicable taxes and duties are shown at checkout where we are able to calculate them.
For deliveries outside the United Kingdom and the European Union, import duties, customs charges and local taxes may be payable on arrival. These are your responsibility and are not included in the price or shipping cost unless stated otherwise at checkout.
6. Orders
Your order is an offer to buy. A confirmation email acknowledges that we have received your order; it does not mean we have accepted it. A contract between you and us is formed only when we dispatch the goods.
We may decline or cancel an order, including after confirmation, where the item is unavailable, where there has been a pricing or description error, where we cannot obtain payment authorisation, or where we suspect fraudulent activity. If we cancel an order you have already paid for, we will refund you in full.
We reserve the right to limit quantities per customer, per household or per order, particularly for limited releases.
7. Payment
Payment is taken at checkout through our payment providers. By submitting payment details you confirm that you are authorised to use the payment method.
We do not store your full card details. Payments are processed by third party providers subject to their own terms and security standards.
8. Shipping and delivery
Delivery times and costs are set out in our Shipping Policy and at checkout. Delivery estimates are estimates only and are not guaranteed.
Risk in the goods passes to you on delivery. Where you are a consumer, this means risk passes when the goods come into your physical possession or that of a person you have nominated.
We are not liable for delays caused by events outside our reasonable control, including customs clearance, carrier disruption, extreme weather or industrial action.
9. Right to cancel and returns
If you are a consumer in the United Kingdom or the European Union, you have a statutory right to cancel your order within 14 days of receiving the goods, without giving a reason. To exercise this right, notify us at info@jaffary.com within that period.
You must return the goods within 14 days of notifying us. Goods must be unworn and unused, in their original condition and packaging, with all tags attached.
Separately from your statutory rights, we operate a 30 day return policy. Full details, including how to start a return and which items are excluded, are set out in our Refund Policy.
Nothing in these Terms affects your statutory rights as a consumer, including rights relating to goods that are faulty, damaged or not as described.
10. Intellectual property
All content on the Site, including the Jaffary and Jaffary Studios names, logos, monogram artwork, graphics, product designs, photography and text, is owned by us or licensed to us and is protected by intellectual property law.
You may not reproduce, distribute, resell, or create derivative works from our designs or content without our prior written permission. You may not use our trade marks in connection with any product or service that is not ours.
Purchasing a product grants you ownership of that physical item only. It does not transfer any rights in the designs or artwork applied to it.
11. Acceptable use
You agree not to use the Site for any unlawful purpose, to attempt to gain unauthorised access to it, to interfere with its operation, to scrape or harvest data from it, or to upload malicious code.
Where the Site offers restricted or invitation only areas, you agree not to share access codes and not to attempt to access those areas without a valid invitation.
We may suspend or terminate your access for any breach of this section.
12. Third party links and services
The Site may contain links to third party websites and may rely on third party services for payment, shipping, messaging and analytics. We are not responsible for the content, policies or practices of third parties. Your dealings with them are between you and them.
13. Accuracy of information
We take care to keep information on the Site accurate and current, but we do not warrant that product descriptions, pricing, availability or other content are error free or complete. We may correct errors and update information at any time without notice.
14. Disclaimers and limitation of liability
The Site is provided on an "as is" and "as available" basis. We do not warrant that it will be uninterrupted, secure or error free.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited.
Subject to the paragraph above, we are not liable for any indirect, incidental, special or consequential loss, or for loss of profit, revenue, data or goodwill, arising from your use of the Site or from any product purchased through it.
Subject to the same paragraph, our total liability arising out of or in connection with any order is limited to the amount you paid for that order.
These limitations do not affect your statutory rights as a consumer.
15. Indemnity
You agree to indemnify us against any claims, losses and reasonable costs arising from your breach of these Terms or your misuse of the Site.
16. Changes to these terms
We may update these Terms from time to time. The version published on the Site at the moment you place an order is the version that applies to that order. We recommend reviewing these Terms before each purchase.
17. Governing law and jurisdiction
These Terms are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction over any dispute.
If you are a consumer resident in the European Union, this choice of law does not deprive you of the protection of any mandatory consumer protection rules of your country of residence, and you may also bring proceedings in the courts of that country.
18. Severability and waiver
If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force. Our failure to enforce any provision is not a waiver of our right to do so later.
